    Default Medical Debt Never Billed For

    I live in Ohio & was contacted by a debt collection agency for a medical bill I was never billed for. The date of svc they listed on the notice was 2001. I didn't move until several yrs later. They first left a msg on my voice mail and for some reason I called and now wish I hadn't, then I received the notice. Tho I did finally find paperwork from my insurance company on this bill, I did not find a invoice or notice of any kind from the medical company. I asked the coll. agency to send me the original statement which they said would take 2 to 3 weeks before I would receive it. That runs out almost the 30 days I have to respond. The debt is less than $200. I do not think this is fair but I do not want a black mark on my credit as I always pay my bills. I do have some statements for the Doctor fees that do not include billing for this lab or testing charge. Could I just send a copy of that as proof I was never billed, or should I ask them for a copy of what the charges are actually for instead of just a "statement" or just pay it. ? Not sure what the statute of limitations is in Ohio for this. TY.!!

    Get their address information and put a dispute in writing (send it certified mail, return receipt requested) to back your verbal request. This puts the burden on them. In addition, check to see what the Statute of Limitations is for your state. This may be a junk debt collector which has purchased the debt for pennies on the dollar and is attempting to collect it beyond the SOL.

    There are several dispute letter examples on the 'net. You can find good ones if you search for them.

    I collected Ohio debts and we usually would not go beyond 5 years because that was the SOL in WV and most of the debts we collected for Ohio debtors were made in WV (we collected for WV hospitals). If I recall correctly, the SOL was much longer if it was an Ohio debt generated in Ohio.

    Thanks, I will do that. Even if I did pay it, how would I be ensured of getting a receipt from them that it was paid.

    Ask for documentation agreeing to the payment/settlement amount/terms prior to settling. Pay the bill with something other than your checking account, but something that has a verifiable receipt. Send the payment via certified mail, return receipt. You will then have a lot of documentation that it was paid.

    You also have the right to refuse to work with the collection agency and work directly with the doctor's office. Read up on the FDCPA.
