    Post Entry To The US With A Dismissed Shoplifting Charge

    I am on H1B, and a few months ago I got arrested and charged for shoplifting (a misdemeanor). I have no previous record whatsoever and have been in the US for about 10 years (college, grad school, work etc) The judge dismissed the case, I did not plead guilty, nor did I confess to the offense. However, I had to participate in some educational program for 3 hours. And the record was expunged later.

    Question:

    1). If I travel outside the US, will I be able to get back in with no problem? I need to renew my visa next year at a port of entry. Will I be denied renewal? Do I need to report anything on that visa application form?
    2). Will it impact my green card application since I am on track for that as well?

    Appreciate any response, especially from the ones who had similiar experience.

    I can't guarantee that anybody who chooses to commit a crime while a guest in another country, whatever that country is, will have "no problem" getting back in. When you choose to commit criminal acts, one possible complication is that it will interfere with future visas or immigration.

    Shoplifting is a crime of moral turpitude, but is likely to fall under the "petty theft" exception such that it does not render you ineligible to enter the United States.

    If you are asked about your criminal history, you need to answer truthfully.
