Here is the run down on my situation.

In 2002 someone stole my identity. He used my information to open a checking account in Houston.

What this guy did was go all around the State of Texas writing checks at various Walmarts in large amounts (just under the 500 dollar limit that Walmarts have). What he did was write my liscense number and date of birth on the checks. So, the check writing companies and the courts think it is me.

The guy was caught in 2002 or 2003 and arrested. I'm sure he is still in jail or prison since it was his 2nd offense of fraud.

But, since he went all around the state there was no telling what was cleared with his arrest and what was still out there.

Well, eventually his wrong doings caught up with me.

Last year I was arrested for a warrant in a county up by Dallas. I bonded out of jail.....contacted that county......filled out the paperwork that they sent me (affidavit, hand writing samples, and statement) and even had it notarized. So, they dismissed the charges for forgery and that was cleared up.

Just the other day I was speeding......highway patrol pulls me over.......gives me my ticket and tells me I have a warrant in another county. I tell him what happened.....even have my paperwork from the judge and all the paperwork surrounding the previous case...give the paperwork to him to look over.....he calls his supervisor in the squad car and his supervisor tells him to take me to jail. He said for all they know it was me since it was a different charge. So, I bonded out again...and i'm in the process of clearing this one up.


So, can I sue the county or the highway patrol for false imprisonment? Or, am I wasting my time?
