    Default Custody Of an Unborn Child

    My friend wants to end her relatioship with her current boyfriend who is the father of the baby she is pregnant with, the mother has a job and father does not. The father plays videogames and stuff all day. the mom works at home and she already has a daughter.

    If they seperate, who gets the child?

    Her State is TEXAS

    Well, barring any proof of being legally unfit, Mom would. Dad would have to file for paternity/custody and support. Mom needs to realize that the father, once proven to BE the father, will have the right to joint custody and joint legal.
