    As of the divorce you are single. The death of your EX wife has no bearing on your filing status. You may file as Head of Household if you meet the qualifications.
    The above assumes that there are no issues with regard to legal seperation or any other reasons to be concerned about 2006.

    I had heard somewhere however that even if I am married as of January, I have to file as Married?

    Your marital status for filing purposes is determined as of the last day of the year.
