    Default MDOP For Dog Killing Neighbors Cat

    I live in Lenawee County in the state Michigan. My neighbor has alot of cats many of which come over a pee in my horse barn, on my hay. Anyway they called the sheriff's department thinking my German Shepherds killed one of their cats. The deputy gave me a loose dog ticket without even seeing the dogs loose and said she was going to submit a complaint to the prosecutor for a MDOP against me for my dogs killing their cat. She also said that they can sue me for this in civil court too.
    Can I get charged a MDOP for this? If so what happens?
    Can the neighbors sue me?
    I looked all over the internet and found nothing about this particular situation.

    It sounds like your neighbor (and possibly the deputy) believe you intentionally had your dog kill the cat. You don't seem to be denying either that your dog was running loose or that it killed the cat.

    They can sue you for your unrestrained dog's killing the cat, but if we're talking about a "domestic shorthair" the market value is minimal. Michigan doesn't permit emotional damages for pet death cases.

    I know that my dog didn't kill the cat, the cat was in their yard dead when I woke up in the morning. My dogs were not let out until later. The neighbor thinks it was my dog because he saw them run over there and were sniffing around the dead cat for about 30 secs before they came back when I called. I have tried getting a hold of the deputy to ask if she checked to see if the cat was stiff already when she looked at it. But she hasn't called me back.
    We have an invisible fence that usually works great but for some reason the signal has decreased and now I have to replace the wire.

    I thought it was odd that she was going to try to charge me with malicious destruction of property. I will fight it tooth and nail if they try. I was wondering if it was even a possibility...if there was a law.
    I work as an ER RN and I don't want anything messing with my license.
