    Default Limit On Reporting Criminal Record

    I live in Illinois and I want to know if there is a legal limit for reporting a criminal history? I've heard that California can only go back seven years. I know that some employers go back 5 or 7 years. However, is there a legal limit in the state of Illinois?

    Illinois - employers & arrests/convictions:
    arrests: Employers may not inquire into or use the fact of an arrest as a basis for refusing to hire.
    convictions: Employers may inquire into & use the fact of a conviction as a basis for refusing to hire. But under the Criminal Identification Act, employers may not inquire into or use the fact of a criminal history record that has been expunged, sealed, or impounded, & employers must include on applications language stating that applicants aren't obligated to disclose expunged or sealed records of arrests or convictions. Those requirements of the Criminal ID Act, however, don't apply to the state police, Dept. of Corrections, prosecutor's offices, other law enforcement agencies, etc.

    It's up to the employer how thorough of a background check will be done (ie how far they will go back) - all background checks are not done the same.
