    Question Steps To Take Before Trying For Emancipation

    I live in Virginia. I'm 15. I don't have a job, and i have no where to live. I can't stand my parents and desprately want to be emancipated. I know i have to be 16. I know i need a job, and a place to live. I still have time to sort those things out and thats what im planing to do. I have a few questions about getting emancipated.

    1. Do I have to hold onto a job a certian amount of time before i can be emancipated?

    2. If I was emancipated would it be valid in a diffrent state? (like NJ, i would like to move back there if this works out)

    3. If i can support myself but my parents won't let me move out, would it matter?

    4. If i get married & live with my husband but don't have a job, can i still get an emancipation?

    5. If i have a job & a place to live but need a room mate to live there, could i still get an emancipation?

    Where I know of no time frame a few weeks isnt going ot go well. Plan on finding and keeping your job at least 6 months before you face judge

    Depends on the state and at this point I have not even looked up to see if yourstate has a statute

    3. If i can support myself but my parents won't let me move out, would it matter?
    Your parents can contest the emancipation but if granted their belssing ownt matter


    4. If i get married & live with my husband but don't have a job, can i still get an emancipation?
    Getting married requires parental consent but if they did and did you would be emancipated by marriage. However if the marriages end before your 18th birthday you revert back to parental care

    5. If i have a job & a place to live but need a room mate to live there, could i still get an emancipation?

    Yes but you need to show the judge you can support yourself in case your roomate bails. Its best to prove you can live without help

    Quoting Virginia Code § 16.1-331. Petition for emancipation.
    --------------------------------------------------------------------------------

    Any minor who has reached his sixteenth birthday and is residing in this Commonwealth, or any parent or guardian of such minor, may petition the juvenile and domestic relations district court for the county or city in which either the minor or his parents or guardian resides for a determination that the minor named in the petition be emancipated. The petition shall contain, in addition to the information required by § 16.1-262, the gender of the minor and, if the petitioner is not the minor, the name of the petitioner and the relationship of the petitioner to the minor.

    Note that even if you can prove that you are able to support yourself, unless emancipation is sought based on marriage or military service, the court must find that "the minor willingly lives separate and apart from his parents or guardian, with the consent or acquiescence of the parents or guardian, and that the minor is or is capable of supporting himself and competently managing his own financial affairs."
