    Default Florida Emancipation Law

    Well, i am a fifteen year old girl who thinks that it would be best to move out. My situation is quite simple. I live alone with my mother. I have no syblings, and my father is dead. She works endless hours and i do not see her very much, but most of the time she's off, she's too tired and stressed. However, our relationship is very strained and the stress she lives with has intensified. How so that we've reached a very near violent encounter. She has a problem when she gets too heated up she becomes paralyzed, and it's the second time it's happened. I'm working towards a scholarship and am looking for a job. I'm willing to work in the whole weekend and in the afternoon on the weekdays when i'm not in school. I'll be sixteen in less than a month.

    Anyone out there willing to give me a hand on the steps i should take from here towards emancipation?

    First, your mother would need to petition the court for emancipation to be considered.

    Is she willing to do that?

    Second you need to be at least 16

    Third, you need to be gainfully employed to the extent that you can prove to a court that you are capable of paying your own rent, utilities, food, transportation, healthcare needs, clothes, etc. AND have a reasonable plan in place to finish at least high school. Make a realistic budget of these costs and show the court your paycheck stubs to prove that you are capable of paying your own way. Until you can do that, there's no point to attempting emancipation.
