    Default Paternity For a Child Born After Divorce

    Hello I am typing becuase I have a situation that recently developed. My ex husband and I had a child after our divorce. Before I knew I was pregnant I started dating someone. He is aware that he is not my childs father but he feels that since he has been in the picture for the pregnancy and we are still together that his name should be on my childs birth certificate. Is that something that can be done?
    Secondly my ex husband was unable to be at the hospital for the birth due to incarceration for child support. He was unable to sign her birth certificate due to this. Can he sign later? an if he decides not to can her name go in the other parties name?
    My child is only 1 month old and I am weighing the pros and cons to both decisions and what would be best for my daughter considering we have a older son together that he does not pay child support for already.
    I was also a little confused because her birth certificate automatically had his name on it even without a signature. The lady said the hospital processed the information based off the information in the system from when I had my son. The state is Georgia and South Carolina

    The child was only born in one state - which state is it?

    Speaking generally, if your ex-husband has already been named as the child's legal father, and is identified as such on the child's birth certificate, he doesn't need to take further steps to establish legal paternity. The non-father cannot disestablish your husband as the legal father, as he cannot establish his paternity.
