A close friend of mine came here on a visitor's visa. He applied for amnesty. While that was pending he applied for residency. The residency application is currently pending. However, the amnesty was denied and they picked him up this morning and immediately sent him back to Columbia, since his visitor's visa was expired (so technically he overstayed his visa).
My questions are: in this circumstance, does the 10 year no re-entry rule apply? If so, is there any way to fight that? Is there anything I can do (as an American citizen) to help him? What can or should he do at this point in order to be able to come back? What happens if his residency gets approved since he's already been deported or does the fact that he's been deported completely mess up his residency application? Any advice/help is very appreciated.
