    Default Pay for a Salaried Employee's Sick Time in Georgia

    I am a salaried employee for a local store in atl. i never signed a contract of any sorts for this position. the question i have is that i got sick today and took a 1/2 day. my boss told me i can take it out of my vacation time, or i can take the 5 hours out of my next pay period... i didnt know if it was supposed to be like that, or am i supposed to have vacation time AND sick time. please help.

    No Federal law and no law in any state requires an employer to provide EITHER vacation or sick time for any employee. Both are entirely at the opt of the employer.

    That being said, while the law does not require an employer to provide any paid time off benefits, there are laws that affect the situation you describe, but we don't have enough information to say if they apply. So this is what we need to know:

    1.) Are you exempt or non-exempt? Salaried is only a pay method and has no legal status of its own
    2.) Does your employer offer paid sick days at all?
    3.) If so, how many?
    4.) Had you used any previously?
    5.) Did you miss any additional time other than the half day?

    i do believe i am a non-exempt salaried employee, i do not ever get paid overtime.
    i have never been offered sick days before, i've only been salary since september.
    i havent missed anytime since august when i missed 2 hours one afternoon. but i was hourly at that time.

    Non-exempt means that you DO get overtime. Since there's a question about it, give us an idea of what your job duties are. It makes a difference; if you are non-exempt, they do NOT have to pay you when you miss time for illness. If you are exempt, in some instances they do.

    So we need to clarify your exempt/non-exempt status, and that means knowing what your job duties are. Not your job title, your job duties. Please be detailed.
