    Neglected Eucalyptus Trees Endangering Home

    I'm living out in the county of Jamul, CA and I'm not sure what I should do in this situation. There are roughly 30, 80' Eucalyptus trees towering over our house that have never been maintained. The neighbors had promised two years ago to have the trees trimmed but never followed through with any action. Every tree has a branch that is trespassing into our yard and a month ago when the santa ana winds whipped through the county our entire yard was littered with leaves and branches that took the gardener 2 weeks and 14 trashcans to clean up. The gardener has started throwing large branches over the fence back onto their property and this of course upsets them but seems to be a good way of reminding them of the problem. The fire department suggested we hire someone to trim the trees and present the bill to the neighbors and when they refuse to pay take them to small claims court. We really cant afford to pay the several thousand dollars it's going to cost to maintain the trees and then turn around and sue them when they refuse to pay. I was thinking perhaps if there was a way for us to find out who their homeowners insurance carrier was and contacting them about the trees. Any suggestion would be greatly appreciated.

    There's a summary of California tree law here (PDF). If the trunks are exclusively on his property, the trees are his. If you were so inclined, you could cut only those parts which extend over the property line. However, you cannot trim the trees in such a manner that would seriously damage or kill them (more details in the article).

    If your neighbor is negligent in caring for the tree, and that negligence results in damage to your property, you can make a claim with his homeowner's coverage or sue.
