Default Criminal Trespass and Court Documentation in Texas

    in Texas,
    Another question!

I was involved in my daughter's order of protection hearing. I had taken some photo's of damages to my daughters car which made me a witness. When question by the defendant's attorney during the proceedings, I was asked why the defendant was not welcome in my home. My reply was that I had issue with my daughter's treatment by the defendant and that the defendant was not and would never be welcome in my home.

Does this dialogue in the court transcripts facilitate that prior notice had been given restricting access to the homeowners property?

We weren't there, and we don't know what was said. Order a transcript and have it reviewed by your lawyer.

Let me rephrase my question since this is a forum that offers assistance under "Expertlaw" heading and my question may not have been clearly stated.

If in a court hearing, a statement is made while under questioning, and the response is that certain individuals are not allowed on your property, can that used for future reference where trepassing is involved?

    thanks

You should note that being discourteous is not likely to inspire the volunteers here to help you out.

The answer to your 'rephrased' question, also raised in other threads, is the same - We weren't there, and we don't know what was said. Order a transcript and have it reviewed by your lawyer.
