    Default Child Support to a Child With a Child

    I am wondering if I can emancipate my child at 19 years old. She is a college student and recently had a child (last July). I feel that if she is old enough to have kids she is an adult. I would much rather give her money if she would need it instead of giving it to her mother to restore her car. Any ideas? This is in Indiana. Thx.

    At 19, she is already legally emancipated (with the exception of needing your income for college tuition purposes).

    Actually the state is covering college since she is a single mother. What I am wondering is how to end support that states I pay through college.

    If your child support order provides for continuing support while she is in college, it's unlikely that you can change that unless she is now financially self-sufficient. What does your support order say?

    I checked my court papers and it says nothing about paying through college. It does not state when support is to end. It only states how much every week.

    Indiana is one the states that has CS going until child is 21. Pregnancy/Child birth, in of itself, is not an emancipating event.

    You mean to tell me no matter what happens I have to pay till she is 21. If she gets married or moves out of her mom's that would still mean I pay support?

    No. Re-read the statute I posted the link to. IF your daughter is living on her own and is self-supporting then you could file to stop support based on her emancipation. But having a baby does not legally emancipate her.
