    Default Mentally handicapped Adult needs permanent residence

    Mother and adult mentally disabled son came to visit sister on visa. Mother died during visit and visa for son expires. The son has the capacity of a five year old and can not care for himself. What can we do to get his residency permanant? :?: Our paper work keep getting rejected.

    Default Immigration for Mentally Disabled Relative

    We have no way of knowing what paperwork was submitted or the grounds upon which it was rejected. Your best bet is to take the paperwork you have submitted to date, along with the response letters / rejections, to an immigration lawyer and formulate a strategy your lawyer believes could be successful.

    There are many unknow issues. However, the potential strategy is to adopt the child. It really matters how old he is, what your legal status is, etc. In general, children under 18 do not accrue unlawful presence. However, you should certainly consult with a qualified immigration lawyer. Where do you live?
