Default Do I Get My Ring Back?

I had two children with a women that I evently proposed marriage to. A few months later she left me took our children and filed papers for child support. I am wondering if she is susposed to return the ring to me since we never got married. The ring was purchased for about $20K and my attorney said no its hers.. This took place in Ca. Just curious because I watched court t.v. and it had a similar csase.....(judege Judy...lol)

Was the ring an engagement ring? If yes, then she has to give it back.

I remembered this case name from past research and it turned up. It is a decade old case from KS's court of appeals. Scroll down to find any california citations in the body. If case law holds true today, yes, I agree with BSG, it is a "conditional gift", if I am reading it right, and must be returned. Further research may be required by yourself at a law library or you can consult an attorney.

    "Other courts have reached a similar conclusion. See Simonian v. Donoian, 96 Cal. App. 2d 259, 215 P.2d 119"...

    Also:

"An extensive discussion of the topic can be found in Annot., Rights in Respect of Engagement and Courtship Presents When Marriage Does Not Ensue, 46 A.L.R.3d 578."

A.L.R., American law reports, is a series of volumes on American state case law.
