    Default Validation of problem with MBS from a vendor

    We are an unpaid MBS vendor and MBS didn't pay us before the hurricane - so the hurricane "victim" excuse has no weight with us. I would recommend to vendors that they carefully consider entering into business with MBS Property Management. I have worked in the property management industry for 17 years and it is really sad that MBS property management gives such a "black eye" to the entire property management industry.

    Did you sue and get a judgement against MBS or Smuck?

    Well first of all, I'm wondering why NO ONE except myself has the nerve to list their name or a reference that associates a human to their post. I'm going to answer your question, even though I have no way to tell who the heck you are or who you even represent.

    I have not initiated a lawsuit or lien and probably won't - I don't want to put more money into this situation. Besides, I'm fairly confident that there are 100's or 1,000's of claims in front of me and my amount is not big enough to pursue.

    Default Where to even start?

    You know it's bad when I google MBS looking for more numbers to call and see this. I was a former tenant at the AMLI at Walnut Creek complex in Austin TX. I moved out of my apartment the very same day MBS moved themselves in (June 28th '05). After a month and no deposit refund, I called the complex. I was then refered to their corporate office, was transfered to numerous people, and then last month was told to start talking to the regional office instead. I guess they got tired of me calling everyday for 2 months *rolls eyes*

    I'm now living outside Seattle for the next 9 months and won't be back in Austin until next August. I'm not sure what to do at this point in time. I've sent 2 certified letters, and no response. No one ever returns my calls, when I do get a hold of someone I get no answers and they pretty much act as though they're doing me a favor by talking to me. I've contacted the Austin Tenants Council and the Attorney Generals Office, but have recieved no help from them.

    So what can we as the American public do to take control back? I'm sick and tired of these corporations treating us as if we are nothing. If it were not for the tenants, these people wouldn't even be in business!

    I'm at my wits end. If I had the time and the cash I would fly down to Houston and sit in that damn building until someone brought me my check.

    Is there anything we can do as a group to bring these slum lords down? I'm open to pretty much anything at this point in time. I want them to be held accountable for the things they have done to people, and it's pretty apparent no other government or state group gives a rats ass.

    Hi LostMystic,

    I'm a former tenant of Walnut Creek looking for my deposit as well. Did you know that if your deposit isn't returned within 30 days, you are entitled to $100 + three times the amount of your deposit + attorney/court fees?

    It sounds like you have done everything correctly so far...now you just need to file your original petition with JP Precinct 1.

    Just last week I submitted my original petition (filed a lawsuit) with the Justice of the Peace court (small claims) and am waiting for a return receipt from the post office. The court now has to serve Smuck with the lawsuit, which since his office is now in Harris County will be done by a constable there. They will attempt to serve him three times, after which they will leave the papers with someone at his office that's over the age of 16.

    Assuming Smuck doesn't try to settle and the thing gets to trial, he probably won't show. In that case, I get awarded the judgement and I'll have to get a writ of execution. The constable will then go out and collect.

    Once everything is said and done, I plan on detailing my information on a website for all former Smuck tenants, so that they can do the same thing.

    The funny thing is, because Smuck misses the 30 day return window, tenants are entitled to the $100 + 3 times reimbursement even if they left the unit in a condition that a decent landlord would have legally deducted from the deposit to fix up!

    Anyway, I'll be glad to give you whatever info I have. You have to hit these guys where it hurts. The MONEY. If enough former tenants were to do this, it might have some kind of impact.

    Another Walnut Creek tenant eh? I wonder if we knew each other - lol. I moved around a bit in that complex....started off in building 15, then went to 6, then after some flooding I moved to a third floor apartment in building 17.

    Oh yes, I'm fully aware of being able to take them to court and tried using that angle back in August when I first started talking to the corporate office. I would have already filed, but I'm no longer in TX so I'm not sure what I can do at this point.

    I wish there was something more we could do to bring this guy down. I'd be happy walking away with nothing if it meant he was out of business. I mean what recourse in addition to small claims court do we have? He can't be allowed to continue on in this fashion. Like I said earlier, I'm sick and tired of these corporations thinking they can do what ever they want. Enough is enough!

    Unfortunately while much of what he does is definitely illegal, it's really nothing that would land him in jail. As far as his business goes, there's really nothing that can be done unless you can affect his money.

    There are ways to complain and put petitions together, submitting them to the Attorney General's office and such, but that's about it as far as I know. I mean, he's indebted to the government many times over, and they still won't do anything about him. I'm sure you've heard about the Seabrook water thing in Houston.

    It's all stuff that you have to come back after the fact and sue for.

    I do have an idea though that would at least get him investigated to some extent, and a list of signatures or something would be helpful, but I'm not to that point yet. I'll see how my own situation goes and go from there!

    Default Here's our story

    Well, after reading this site, I think MBS should be put out of business. And after spending 3 years on his property that has been "professionally managed", my wife and children and I are done. This man has disgusted more than me and my family. He evicted (or as they say, chose not to renew) tenants of almost 30 years, and has let tenants in that have paid a $99.00 move in fee and paid nothing since. Now this all makes sence doesn't it?

    Well, we are really tired of it and we are leaving.

    I know that "they are going to go after us for lease termination" but how is that possible when they can boot someone out of here with no reason and no notice.

    Anyway, my final word to all is this, if there is an MBS flag flying over the apartment you are considering renting, consider another, and if there is no flag at all, make sure you find out who is managing it as you will pay for it in the end if you don't know.

    I think one other thing might help all the apartments that are "managed" by this company. Maybe someone should notify the media and then organize a picket of the properties and make sure that his company is notified JUST before air time. As the pickets are video taped, make sure the addresses are on all of them and see if maybe this helps drive away business. Like has been said on here, the only way to hurt the company it to hit the wallet. You give enough bad publicity and the wallet will go low and maybe, just maybe, the city officials will listen.

    I know here that the city officials are PI__ED at him, but I think their hands are tied a bit, but I am sure that they are waiting for the "day to come" where they can get their gloves off and hold tight to his neck.

    Well anyway, good luck to all, and a little advise, go find some where else to live, put this man down and make successful all of your dreams, including the one that he gets what is coming to him.

    Hi MBS Loser, thanks for your input.

    The "beautiful" thing about Smuck's scheme (and what needs to be exposed) is that the public is paying him to keep his business operating.

    Even if MBS became a name that apartment-seekers kept on their "no way!" list, the fact that Smuck accepts Section 8 vouchers pretty much guarantees occupancy in his complexes for as long as they are habitable.

    Again, what needs to be emphasized is that the government, and therefore INDIVIDUALS' TAX DOLLARS are putting money in Smuck's pocket.

    I plan on eventually contacting authors of articles on Smuck and seeing if they might be able to help in any way.
