I hope someone can help me with this. It is actually my boyfriend who has the problem. He has lived in his apartment for over a year and has had about three or four roomates in that time. All of them left without any problems. His current roomate is a friend who he was helping until she got on her feet. She has four kids and at the time that they moved in her, her mother, and all four of the kids were living in a hotel room. Only her and the kids moved in while her mother made other arrangments. After she had been there for a couple of months, my boyfriend was told that he had to put her on the lease. So he did with the understanding that she would be leaving in a month or two, but would pay half of the rent while she was there. Well, after about two and a half months she sent all four of her kids to live with their other grandmother in Texas. Once she did that it was understood that she would not be there for that much longer. That was back in May. It is now October and she is still there. This would not be a problem if it were not for the fact that she often does not have her part of the rent and she physically attacked my boyfriend. He soon after, got a restraining oder on her. But it does not state that she has to leave the apartment she just has to leave him alone. The problem is that he wants her out. Due to her not having her part of the rent, my boyfriend has to find a way to come up with it. Because of this, they have been late on the rent every month since she's been there. They just received a notice the other day stating that if they are late one more time they will be evicted. Well rent is due in a couple of days and she came to him this morning and told him that she doesn't have her part...again! He has a friend that is ready to move in but he can't until she is gone. With her name being on the lease, how can he get her out without it affecting him and his apartment? What rights does he have? Any answer will be good. We just really need help with this.
