    Default Disclosing a Theft Incident On Form I-539

    hi all
    i dont know wot i was doing when i listened to my frnds(not any more)....cant blame anyone for wot i did.......but i surely m sorry for my act....its embarassing,takes away ur sleep,the terror haunts u......n so on....belive me i have gon through dat.......i had posted a thread for the same before but was unable to find it...so here i m...........in my last thread i was adviced by u all to hire a lawyer against my case.....i was charged with petty theft-total was 150$ n it was in california........so today was the first hearing of the court n i was told not to come by my lawyer...well even at home also i was praying n asking for forgiveness...so my lawyer called n said that he got it down to a conviction of infraction.....now another problem is dat i have to file a exten. to my h4 visa n in form 1-539 it asked whether i have been arrested or convicted of any crimainal offense.........please tell me i know i have to write yes.....but it asked i need to give explaination..............so do i need to write the whole thing....or i should say convicted for infraction...............please advice...........thanx

    i am sorry if you felt that way.....but i guess i tried to wrote in a simple way but if you have understood than please advice and if not than what i am trying to ask is - should i write yes in I-539 form,where they asked whether i have been arrested or convicted,and if yes then i have to tell why?so,should i write the whole story or should i just say charged with infraction.
    today was my court date and my lawyer got my charge of petty theft to infraction,490.1.
    thank you for your patience....please advice me on this,as after listing to you only i hired a lawyer and it did gave me some peace of mind.

    Your question is more of an "Immigration law" question, then a "Larceny Question". You should ask it in an "Immigration section" and NOT in this "Criminal Charges" section.

    Your I-539 does ask if you have "ever been arrested or convicted of any criminal offense since last entering the U.S.?"
    So, you must enter YES., and add extra paperwork explaining the dates, and that it was reduced.

    But I don't know how this will effect you? It might get you sent back.

    You need to find out, in an "Immigration section" or find an "immigration Attorney".

    And I understood your question. Don't mind panther10758, he only knows his own language and he doesn't understand much about even that one.

    You didn't identify your state. Depending upon state law, the infraction is likely to be classified as a non-criminal offense. If that's the case, you weren't convicted of a criminal offense. But laws are different in each state.

    You haven't told us whether you were arrested for a criminal offense.

    Should the question arise, you were unquestionably charged with a criminal offense.

    hey,thanx for ur reply.......my state is california and no i was not arrested but i was booked...so my lawyer says it is equal to arrest..................
