    Default My Pregnant Girlfriend Wants To Be Emancipated

    My girlfriend is currently 16 and would like to be emancipated and I am wondering the best way to go about doing so. Her parents are divorced but still live together, her mom has no job and is very controlling over her entire family including her father who is pretty much her little bitch (excuse my french). Her mother is extremely abusive emotionally but not physically so I believe this will be much harder to prove to the court. She has a job and a car, which is almost pointless; when she gets paid her mom makes her fill the gas tank in her car, then her mom takes her money and steals her car (without a license) and disappears for 2-3 days on a crack binge. This may be hard to imagine but I have seen it first hand. Several people have called CPS and nothing has been done although they say something will be. We recently found out that my girlfriend is about 3 months pregnant and she can not deal with her family and does not want our kid growing up in that household. I am not sure what to do but I am about to break down and cry because of all the shit we have gone through.

    I am sorry if this is hard to understand but without showing you all this it is so hard to explain. I hope you can help.

    If she's pregnant, her odds of emancipation are extremely low. How is she going to be able to convince a court that she can afford to independently support herself and a child?

    There is a pregnancy clinic near us and we have visited it several times. They have a program that they want us to start doing there, and if we participate they will help us out with physical objects needed such as cribs, car seats, baby food, and such. They also help pregnant teens and adults with low incomes get enrolled with different programs provided by the state which should help us out tremendously. Besides this I also work and want to help support my child, I will not abandon them.

    If you and the clinic are supporting her, then she is not self-supporting. If she is not self-supporting, she cannot be emancipated.

    Is there anything else I could do to help her. CPS will not help, or at least have not yet and I am starting to get fed up with the BS they give when we call and complain that nobody has been out there yet. We have found a lawyer who may be able to help get her out of her house, where she will go I have no clue. I am starting to get worried though, if the courts decide to put her into a foster home instead of granting emancipation (which it looks like may happen) this could cause a problem with her having my child. If she were not pregnant I would want this more for her because it would be better for her. Please don't get me wrong, I am not trying to be selfish but I don't want to lose her and by unborn child.

    If she doesn't qualify for emancipation, and it does not appear that she does, then emancipation is not an option. Additionally, it is not within CPS's ability to emancipate her. That can only be done by a judge and it will not happen unless she can successfully prove to him/her that she is capable of independently supporting herself and her child while still going to school.

    I think you need to start realizing that emancipation is almost certainly not going to happen. If it becomes necessary for her to be taken out of her home, foster care and/or being made wards of the state are FAR more likely. Emancipation is a non-starter in this case.

    Thank you, when mentioning CPS, I was simply stating that no matter what we do they will not look into her case, since my original post I have realized emancipation is very unlikely and as for the lawyer, I didn't mean for them to help her get emancipated but simply out of the house (ward of the state or however they decide).

    Do you think that it may be possible (if CPS does by some miracle show up and take her out of her home) that my parents could adopt her?

    Lets see let the the BF parent's adopt the minor so BF and GF can live in same house?...........................................h mmm............................................... ...............NO! that isnt going to happen. Instead looking out for your own wants look after hers. CPS (if being abused) is her solution (not yours)

    No, I do not think it will be possible for your parents to adopt her. That is not going to happen just like emancipation is not going to happen. She is not going to be adopted by anyone. Her parents' rights have not been revoked.

    Unless CPS sees fit to take her out of the house, and it would appear that they do not think that is warranted, she is going to stay where she is until she is 18.

    Did you pay any attention to the post at all panther? I simply asked if it was possible, the reason I am here is because I am not familiar with the laws and am asking for help and advice, not to have someone jump all over me. I want her out of her house and if that means away/not living with me then it is better for her. CPS wont do a thing, at least they haven't so far, you do not understand what we have went through trying to get them over to her house. Please don't think I am looking only for my best interest I simply wanted to know the possibilities.
