Are these photos out for public display or only where employees may see? I have not researched your state but the rules would vary by state I am certain
The biggest risk would seem to be mistake - put up the wrong picture, and you risk getting sued.
Talk it over with your insurance company, and make sure you have coverage.
I would guess it would NOT be Legal if the pictures were of "Juveniles"
But if it was Adults it would be Legal, but it would open them up for Law Suits. Even if the people were charged with shoplifting, some may NOT have been Convicted of it, so they could sue.
If the people weren't arrested, how would they know if they are adults or Juveniles?
Most ALL big companies, will not allow "public display" of these types of pictures. One call to a higher office, should get the pictures removed.
With the gas stations putting up pictures of bad check writers, a lot of checks and people identity are stolen. I know I would sue, if I saw my picture and/or name hanging up somewhere, after someone else used my identity.
Check your establishment's ops manual(s). If you have a LP program/department there is most likely some pretty explicit P&P on that sort of activity.
Besides, if you're asking that sort of question in a place like this, then you'd better check with your store manager, his boss, the legal department and lastly your state's privacy statutes. Some states have regulations against that kind of activity.
