    Exclamation Attempting to Flee or Elude an Officer, and Possibly Illegal Stop

    i am being charged with an o.w.i. and attempting to flee or elude a traffic officer. here is how it went down. i was at my crazy ex-girlfriend's house and we were tipp'n a few when she started to pick an argument with me .. again i was getting upset and had enough. i know i should have just walked someplace and called for a ride but i was upset and not in a logical thinking state of mind. i drove but was driving well. i drove about a mile and half or so when i had a police car pull behind my car from a side street. i was driving perfectly , at the same time the crazy ex called to tell me my impending doom. she wanted someone to argue and drink with all night and was mad that left. so she called the police and said was driving crazy and was drunk. at that time the lights came on behind me now i was really freaking out, and i'm a little ashamed to admit that i do suffer from post traumatic stress disorder and anxiety,and not just a little either. so at this point i'm having a full blown panic attack. i stopped at first for a bit,but then i don't know what came over me... i floored it! i went for a mile or so and came to my senses. realizing how pointless ,dangerous, and dumb it is to try to outrun the police. i pulled over and cooperated, all except for the field sobriety test that is. i was not in the mood to jump through hoops when i knew that i would be forced to take a blood test anyway, having had prior o.w.i.'s. as i was in the back of the police car i asked the officer what i did wrong to pull me over. he said that he got a tip that i was driving drunk and reckless, and admitted to me that he did not see me do anything wrong. i live in wisconsin and am told that the police have to observe an illegal activity or violation in order to pull a person over. is this true? now after i received the police report i see his story changed a bit, and said he pulled me over "upon information and belief" that i did not have a valid drivers license. which i didn't.this was at night and no way he could have i.d.ed me in my car. i am facing a good amount of time and a felony to boot ...can someone bounce some things off me? give me some facts...some direction?? i have a public pretender but am not to sure he is competent or even gives a crap. advice would be very mutch appreciated ! thanks, K.G. in wisconsin

    It is quite possible that the officer ran your information based upon your girlfriend's report and your plates, and thus knew of your license suspension prior to the stop.

    Additionally, your speeding away would have been grounds for a traffic stop, even if you previously hadn't done anything wrong. What are you supposed to do when you see those flashing lights in the rear view - speed up, or pull over to (presumably) let the emergency vehicle pass?
