    Default Trespass and Child Snatching

    Texas, DFW area.

    What rights does a homeowner have in filing charges against a daughter's ex-livin's mother coming to said homeowners property, peering in the front door way and attempting to snatching the daughter's children from the homeowner's property witout the daughter's permission?The youngest G-daughter was pulled from the house and was halfway to the perps truck when the homeowner grabbed the 3 year old as he was being pulled from the home. Home owner pulled the perps hands from the 3 year old and put him in the house. the perp was trying to go through the homeowner to reacquire the 3 year old. The home owner pushed the perp away as he sheilded the 3 year old and tried to close the door.

    The perps released the 6 year old as the police rounded the corner and were in site of the home.

    The perp in this case is also attempting to file charges against the homeowner stating that the home owner pushed them up against a wall in the doorway of the home and threatened them. One witness in the home witnessed the entire incident in the doorway which only involved keeping the individual pushed back out of the doorway and away from the child.

    2 passengers with the perp were arrested with warrants unrelated to this incident. police stated there was nothing I could do about the daughter's ex-livin's mother coming on my property??

    What are my options??

    What is a "daughter's ex-livin's mother"? Is that another way of saying this was the mother of the child (or children), who used to live with you?

    It would be the Home owners Daughter's childrens biological fathers's mother.

    Had there been a marriage the perp would be referrred to by the daughter as the mother-inlaw. Or if common law applies, perhaps she is still the daughters mother inlaw

    whatever. as i understand it, it is your daugther's home and her sort of in law tried to take the child.

    she can go after a restraining orders.

    file a police complaint.

    thanks for the reply. the home is mine. Daughter and children moved here after violence and abandonment to try and get back on their feet. Not a word from the biological father and mother inlaw until this event. They were not invited nor welcome at my home and child support/custody between my daughter and her ex live in have not been addressed by the courts.

    I am a homeowner. My daughter has had a 6 year live in relations ship with the bilogical father of my grandchildren. In May this year there was a drinking and violence incident in which the bilogical father left my daughter and the kids. We took our daughter and the kids in to help her get through the legals issues associated with their split up as well as get through the custody and childsupport issues.

    Today, while my daughter was at work, the bilogical father's mother came to the door and did not ring or knock. The biological father and either his sister or ?? were also present in the vehichle blocking our driveway.

    When the grand daughter (6) walked past the door and saw the fathers mother (other grandmother) she grabbed the grand daughter and handed her to the father to started for the parked vehichle. She then reached in and grabbed the gradson (3) as I reached the door. I grabbed the grandson and grabbed the grandmothers wrist to break her grip. She released the grandson. I turned to hand the grandson to a visiting relative, while turned the grandmother attempted to come over me to get back at the grandson. i pushed her back out of the door. Another family member had called the police who were in route. As the grandmother headed for the vehichle I went outside to attempt to get the grand daughter back. About this time the police showed up and the grand daughter was released and returned into the house. the father and his sister or?? werfe arrested with oustanding warrants. The mother wanted to file charges on me for supposedly pushing her up against a wall and threatening her. The family member that was in the doorway witnessed the incident which was not at all what she was telling the police.

    In speaking with the officer he stated that the grandmother intended on filing charges on me tomorrow. I asked the officer what charges could be filed against her for this iincident and to prevent further incidents from occuring.

    So in closing,
    1. What charge could possibly filed against me for protecting my property and the grandchildren?
    2. What charges can be filed against the grandmother to coming onto my property.
    3. What charges can be filed for attempt to kidnap the grand children.

    not trying to be cryptic, just trying to be cautious about how much information in included here.

    The police don't view it as a criminal matter. You can try talking to somebody at the prosecutor's office. If no charges are forthcoming, the parents can deal with it in the custody court and, if appropriate, your daughter can seek a protective order against the grandmother.
