    Default Can Creditors Sell Your Discharged Debt

    Recently I saw an article that seemed to concern a lot of bankruptcy filers. Hopefully I will be able to explain it correctly and when I do, if any of you know about the article, can you please comment. I know for myself, the article really upset me because it gives you the impression that this procedure is legal and nothing can be done about it wether you filed bankruptcy or not.

    The article concerned the illegal practice of creditors that we filed against and the debt was discharged refusing to declare the debt discharged by the courts on our credit reports with the Big 3 credit companies. From what I could understand, this practice causes the person who filed bankruptcy to be forced to repay a discharged debt even though its illegal for the creditors to do this. So, I,m asking...if you bankruptcy discharge paper comes in the mail, you wait an appropriate time and check the Big 3 to see if the discharge information is on the reports, but according to the article, if you make an attempt to re-establish credit or make a purchase that requires credit, you find yourself in an impossible spot if the person you are dealing with will not help you because your fromer creditor refuses to post the discharge information on your credit reports. So if that happens, what do you do and is this legal to do anyway

    Can creditors do illegal things? Sure, but as they're illegal you can avail yourself of your legal remedies. If a creditor violates a bankruptcy court's order, you can petition for a contempt citation.

    the same article you read talked about the NEW market in selling and buying these credits......

    yes they can do it and it can and does cause problems for people. it is an area where government may have to intervene at some point.


    solution: don't have bad debt.

    I tried to find it, but negative results. I remember reading it and the responses to it were disturbing. It basically indicated that a person starting over and asking for credit makes a plea to another credit company. The new credit company runs their credit and low and behold, the credit report indicates that a balance is still open, no information about the credit being discharged in the bankruptcy and the person who is trying to start over tries to make contact with the old credit company about why information is not removed and find that the company sold their debt to somebody else. The person contacts that somebody else and they tell him/her that if they want the credit with the new company, they will have to pay off this old debt. What I can not understand is how the law allows such a thing. The article even mentioned that the person had to eventually take the companies to court, they did win, but had already paid off the amount just to get new credit with this other company.
    We just can not win.
