    Default Backstabbing Supervisor

    I have worked in the same job for the past 15 years at a salary level equivalent to our receptionist yet the job requires a technical background and the expectations have grown over the years. I have always received outstanding performance appraisals and my supervisor is aware of the extra responsibilities and has kept promising to change my grid level. As a result of a re-organization, I was offered a couple of promotions under another supervisor which I initially agreed. This was not supported by my former supervisor and he decided to submit a very damaging letter about alleged comments I made about the re-org plans and employees. As a result of his letter I am now being reprimanded for unprofessionalism and insubordination. I will be placing a grievance and this whole experience has been very stressful and I have been off for about 6 weeks. I am expected to go back to work but not sure since I feel my supervisor has created an unhealthy climate of work for me. I would consider leaving but I love the job. I am considering a lawsuit because I do not feel I can go back and they have cause mental stress. Or the other option is to request for severance pay and look for other employment. I am currently seeking legal advice.

    What is the name of your state - you didn't give it & it's always requested.
    Are you saying you are currently seeking legal advice from an attorney?

    What would you be suing for? Nothing in your post remotely hints of any illegal action by your employer. It's not illegal for a boss to be a jerk.
    Or the other option is to request for severance pay and look for other employment.
    Unless you have a bona fide contract or are part of a collective bargaining unit the company isn't obligated by law to provide one to you or anyone else.

    I am from Toronto, ON Canada and my actual question is whether I have an legal grounds to sue. I feel I cannot go back to a job that I love because of all the lies reported in the letter. I believe I can file a grievance with a response to all allegations. I have panic and anxiety attacks when I think of going back to my job.

    The laws in Canada are quite different then here in the US, so my response was geared towrd someone in the states. As to answering your questions/concerns, I can't and until someone comes along that know Canadian law, you will have to wait.

    Agree - this is normally US law only but possibly someone will come along & know Canadian law. If you have legal counsel, you might go ahead & talk to them.
