We live in Florida...

Closed on our home back in August, a short sale. We now have found
out (after checking our credit) that the 2nd mortgage still wants
$63K , the remainder of the loan.

We never agreed to this amount, in fact, we agreed to $5100 which was
paid to them at closing.

They produced a document, faxed to us, that showed my signature and
my husbands on a paper indebting us to this and agreeing to pay.

The document was forged, and we called the Title Company. The closing
agent has signed a sworn statement stating that she signed our names.

This is not only a crime, but has damaged our credit. (We are in the
process of moving , trying to find a place to rent, new job, etc, etc)

We consulted an attorney, and he says we should ask for around 5K in
damages. The lawyer for the Title company says they will pay off
the 63K.

Other "people" with no legal background, have stated we should try
and get more $$$$ for mental anguish and to not press charges against
this lady. (especially right here at the holidays). She did commit a
3rd degree Felony and has admitted to it!!

So to not press charges, and for our damages and trouble, what do
you think (anyone?) would be a reasonable amount to ask for . ??????

We are seeing the attorney today at 2pm. Our attorney advised us
that if they didn't agree to some type of settlement, that we should
retain him ($1500) and we would sue them for $25K or more... They
would know it would cost that if not more if this were to go to trial.

I want to be fair and reasonable, however, I want this settled and
to not be cheated again1!
