I have intermittent FMLA. I had a flare up at work and left early. The next day I was very sick and was unable to get out of bed I finally managed to call work to let them know, as soon as I could. I was past the manditory "no-call/no-show" cut off time by a few min. I explained this is for FMLA. Some weeks later I had to miss work for a non-FMLA reason, I knew I would get a point for that but was quite surprised to get a "Verbal" for attendance points. They had indeed coded the FMLA but had also given me 2 attendance points for calling past the required call in time. Is this legal? I spoke to HR and to Management and they both assure me I am required to meet the call in requirements set by the company FMLA or not. Any thoughts or suggestions?
