I moved into an apt. in August (almost 4 months ago). Upon moving in the landlord did not request a security deposit. When i moved in I could see why...the walls were horrible and in need of a paint job and the carpet was awful and stained. Two weeks after moving in he began asking for a deposit. My rent is $575 a month. I gave him $200 at that time. I paid the september rent and added an addtional $275 towards security. In september he gave me a lease to sign which I did. In october I was injured at worked and my rent was 2 weeks late. November 1st he filed eviction proceedings against me for "late fees of $5 a day on the $100 remaining". Which comes to over $400 on a $100 security deposit. This deosnt seem fair...can he evict me for this?
