    Default Theft Under $50

    My friend’s wife was a cashier at a grocery store and had previously stolen some items. She did get fired but not for that reason sort of. She got fired because a customer came in to buy groceries and so she went through another cashier she just had charged her for the W.I.C and still had food in cart. she then went to a taco shop they have at the store and came back through the line to my friends wife register, she scanned the items and the customer came short of money so she said she was going to leave the items (which were already bagged) she said that she was going to place the cart with items in front so that the workers can place them back. Management accused the customer for stealing the items (Customer did not even step outside) and accused the first cashier and my friends wife for voiding out the transaction. The first cashiers along with the customer were taken to jail and my friend’s wife got a ticket for theft under $50. Obviously all three got fired.
    She (My friends wife) was told by a co-worker that management from store are going to show up for her court date and try to do something (press charges).
    My questions are: Can they do that? If so what should she do? And finally how should she plea be guilty, not guilty or no contest.

    I'm not entirely clear on what your "friend's wife" supposedly did which resulted in her being charged. Yes, the victim of a crime can ask that the alleged offender be prosecuted and punished.

    She should consult a criminal defense lawyer.

    she has the court date on the 13th of Dec. Can she go before that date to pay the fine? If so what is the difference between pleaying guilty and no contest?
    and one more question, she applied for another job and will start training today but before she goes she has to take a drug test and they told her that they will check her background. since the offence is pending (I'm guessing) will it show on her background now or will it show once she pays the fine.

    How can she pay a fine for something she has not been convicted of as of yet?

    well she was given a ticket for theft under $50.

    Yes thats was a notice to appear. does it say anywhere a fien to pay and how and where? I doubt it. If it does then sure go pay it just make sure its an infraction. My guess is what your friend got was a notice to appear (ticket).

    yes she called me yesterday and said that she received a letter stating that she can pay the fine of $545 by mail or online before the 13th or if needing extention to show up to court. But her concerns are: will that come up on her background? If so, would it show now or later? and her second concern is should she plea guilty or no contest and what is the difference. i guess that makes it 3 concerns.

    Is the charge an infraction or misdemeanor? If misdemeanor then yes it will show on a background check. I would urge your friend to consult a criminal defense Attorney (bring the ticket) and seek some advice

    There should be a charge with the penal code. If not all the more reason to talk with an Attorney
