    Default Moving To Another County During a Divorce, in Texas

    I'm getting ready to file a non-contested divorce WITH CHILDREN in Travis county (currently live in Austin, TX). Me & my future-ex husband both live in Travis county currently, which makes it pretty easy to file; however, I plan on moving in the next 3-4 months to Williamson county (the next county over). I have NOT filed for the non-contested divorce original petition yet, but plan on doing this within the next week or so (have all the appropriate forms filled out). But, since I'm planning on moving into another county within the next few months - it will change everything or will it?

    It is important for me to move because I cannot afford the rent in my current apartment, and I'm moving somewhere smaller & more affordable in a NICER & SAFER neighborhood. Additionally, I'm putting the children in a MUCH better school district.

    Should I delay the move? Is it going to complicate things? Can anyone help me?

    Consult a divorce lawyer about the best strategy. I suspect you will be told that it is best to move and establish residency in the other county, then to file for divorce in that county.

    I hate to wait that long. I want to get this divorce done & over with. Does it go by the county your spouse (who isn't filing the paperwork) lives in - or is it by YOUR county?

    If the kids live with you, you would want to file in the county where you reside.

    I'm just grateful I don't live in Naperville, IL as I would be stuck listening to the commercials too!
