    Default Failured UA on probation

    im in washington. i was charged with theft 3 and possesion of mj and para under 40 grams. no prior record or law trouble.the drug charges were dismissed in a deal with the prosecutor and i plead guilty to theft 3 and got 1 year probation/deferred sentence. on the court order it says consume no alcohol/drugs. on the sentencing paper and the probation paper , however, under the boxes that say drug screening/drug assesment/testing/etc there is nothing checked. Only No Alcohol is marked on the latter two. I had a glass of wine with my girlfriends family for dinner and some marijuana in a cigar [not knowing it was in it]. Had I known I would be required to pass drug/alcohol tests, I wouldn't have had the wine and I wouldn't have taken the cigar. I know I'm not supposed to have alcohol but it was a small glass ... i didn't even notice it effect me mentally. whats likely to happen? what could happen? will I get another chance at probation/deffered sentence? The probation officer said I could lose it. Will they send me to rehab? For how long? Or straight to jail? Will I have a choice of the two? If not, how long in jail? (I need to know the worst case scenarios) ... which reminds me... if i lose my deferred sentence could the dismissed drug charges come back?

    Default Deferred Sentence At Risk

    The probation officer said you could lose your deferred status, not that you will lose it - that's not all bad. It may be that the probation officer is giving you a chance to redeem yourself.

    Telling the judge "I didn't think I would be tested" is almost like saying "But I thought I was going to get away with it". It would likely be far more beneficial to be sincere and apologetic, and take responsibility for your actions.

    You may wish to consult a local criminal defense lawyer about your situation.

    i heard what the probation officer said what im asking is what happens if i do lose it
