    Default Civil Damages Payment in Oregon

    I have just received a letter demanding payment for civil damages to the store that i stole from. I was wondering why I am asked to pay the full possible penalty of $250 (plus merchandise cost) when the merchandise was worth a total of $10? Also it states in the letter that the payment is to be made within 14days of receiving it, which is not possible for me. Should i just allow it to go to court and see if they will order me to pay less than the full fine or contact the store and ask about a payment plan or something alternative?

    You are asked to pay more because they have expenses above and beyond the value of what you stole, and because it is allowed by law. If you force them to take you to court, they will likely increase their demand and the law probably permits them to also recover their lawyer fees.

    You can negotiate with whomever sent you the demand to try to pay a lower amount, or to pay in installments. They don't have to agree, but they may.
