    Default Petty Theft for Shoplifting in Ohio

    Much to my (well-deserved) humiliation was caught with $12.95 of goods at a grocery store last night for the first time in my life after paying for the rest of the items. A LP associate approached me before I went outside and called the police. Of course 3 of them show up and I got arrested and taken to the station where I was booked, photographed, etc. I posted the $374 bond with the money I had on me (I know that I am STUPID, ok?), charged with petty theft/shoplifting and released. The store also took all of my information and photo as I am banned from there for life (am too embarrassed to ever go there again anyway so that's not a problem). The cop told me that this would stay on my record for a year and then what, I don't know. I am to appear in court on Nov.28 Apparently the judge assigned to the case usually asks for fines, diversion, etc. instead of jail time for the first offense. I am willing to get what I deserve and feel that I need help (obviously). The NASP has a self-study course that is $65 for shoplifters, I looked up shoplifters anonymous but was unable to find anything in the entire state of Ohio. Interesting that the resources available to help people stop who want to stop are so thin on the ground. Couldn't even find a self-help book in the library system. There is counseling available at work and I made an appointment but am hesitant about revealing everything to her, so am planning on talking about the anxiety, anger, etc. that I think led me to shoplift. I do have a few questions though:

    Would it be worthwhile to pay $1500+ to retain a lawyer for the court date ? I understand that the judge usually plea bargains with first time offenders anyway and I am sure I'll be facing substantial fines, etc. regardless.

    I called the court and the guy that answered said that a public defender would only be appointed after the first court date-- what if I figure out a deal on that date, should I reject it just to get representation?

    Should I plead guilty or no contest ? I have been on a variety of anti-depressants, anti-psychotic medications in the last year and while I am definitely not blaming them for my actions, I'm obviously struggling with some personal issues and don't know if I should bring up my willingness to get help with these as a factor in my case.

    How does one get records expunged or sealed ? Also would being sent to a diversion program/pay fines be counted as a conviction and would i have to note that on employment applications? Does the arrest still show up somewhere ?

    Public defenders are for those who cannot afford thier own legaL counsel. So I woulod say yes pay the $1500.00 as you may not qualify for PD. You do want legal representation though as its not wise to face criminal charges without an Attorney

    I suggest at least consulting a lawyer before entering your plea, particularly if you are thinking about pleading guilty or "no contest".

    Thanks for the feedback, I did speak with two lawyers over the weekend, one told me to get lost and I am meeting the other this week, however he is asking for a $2,000 "fee" up front-- is this legal ?

    It is legal for a lawyer to decline to represent you. It is legal for a lawyer to charge you for services to be provided.

    I have the same problem and I am also located in Ohio but i went to court and plead guilty and payed my fines. I am looking for the same help I want to make a good living and I do not belive that it is fair the judge someone on one little mistake if you repeat the same offense then yeah.

    That $12.95 is going to mean thousands $$. I already wrote him a $1500 check and he bills $350 an hour on top of that. I only met him for an hour and we haven't even been to court yet. I wish people could read this site before going out and considering screwing up like this.
