    Question Child Support Payments

    Case in Michigan

    Question: If NCP is ordered to pay a total amount per month and it is withheld from his checks bi-weekly per the IWO. What if that total amount is not met during that month period that is ordered by the court? (off by over a hundred plus dollars) Is the NCP responsible to make up the difference?
    Also, NCP claims to have a 40 hr. week job in order to have the payments taken from...but NCP has also not been showing up for work and working else where making more money but not reporting that income to FOC. He claims to have the job for the support to be taken from BUT is not making enough to pay the amount that is ordered and that amount will be going up due to modification per the information he provided to the FOC.
    NCP pled guilty to felony non support, will his not making the total amount of child support payments prior to sentencing effect his sentencing?

    If you are asking what happens if the child support payor doesn't earn enough for the full child support payment to be deducted from the payor's paycheck, the payor accrues an arrearage for any underpayment.

    Discuss this with the victim's rights office of the prosecutor's office, or with the prosecutor in charge of the case.

    Thanks Aaron.

    From the beginning with NCP has been a nightmare. It has taken years to get this far and when I feel that the courts have it under control, I find that NCP seems to find a way to go around it all. What I am wondering is IF his showing that he is not making enough for the support payments - will the courts lower it even more? This will be the second time in the past 5 years or so that he has done this. He either cuts his hours at the job that is reported to the FOC and works else where - or he just quits and the payments stop.
    One would think with pleading to a felony charge would wake him up a bit. But, this seems like a repeat from a few years ago.....
