New Jersey poses a three-part inquiry, on a case-by-case basis, to noncompete agreements:
1. Does the covenant in question protects the legitimate interests of the employer?
2. Does the covenant impose undue hardship on the employee?
and
3. Is the covenant injurious to the public?
You should have the specific covenant language reviewed by a New Jersey lawyer to see if it could be enforced, whether in whole or in part.
