I bought a condo back in 1992 and as owner it had two parking stalls assigned to it ... previous owner who sold the unit to me via MLS had, of course, the same two parking stalls ... the MLS indicated two parking stalls.
The parking stalls, of course, are on common property ... each parking stall is limited common property, meaning back in 1984 when the units were being built the developer registered with the Land Title Office (LTO) parking stalls to each unit ... the owner then has exclusive rights to the parking stalls assigned to his unit.
My unit has had three owners, excluding the developer (original owner of all units).
When I bought the unit 15 years ago, the board of the Home Owners Association confirmed with me which parking stalls were mine. I have had these two parking stalls ever since. Just recently I was informed by the Property Manager that I should have only one parking stall and actually the unit next to me has the right to one of my stalls after the owner inquired as to why he had one stall and other units have two stalls. My unit is one of the largest units in the complex with 3 bedrooms and a den; his unit has two bedrooms and is one of the smaller units. The property manager indicated to me that there must have been a mistake all these years because after reviewing the documents at the LTO it appears my unit has only one one parking stall registered to it; the unit next door has two - one originally mine.
Now I bought the unit with the understanding that I have two parking stalls ... the owner of the unit next door just bought his place in October of 2006 - one year ago. He bought his unit with the understanding he has one parking stall. All these years the HOA, the property managers, the previous owners of the units all had the same understanding.
Needless to say, the guy who has the two parking stalls thinks it great! Now this is unfair and unjust - not sure what I can do. He benefits at my expense ... my unit's value obviously has decreased in value a lot ... who wants a three bedroom plus den with one parking stall. My tenants want out as I am renting out the condo. I want my parking stall back ... or at least be compensated.
