    Default A Subtenant Doesn’t Pay Rent And Refuses To Move Out

    HI,
    My roommate didn’t clean, left her “period” staff on the floor and toilet, watched TV up too 6 am very loudly, didn’t speak with anyone in the apartment and one day she opened official latter to me from my landlord saying than she didn’t know is for me (on the envelop was my full name). She also said she was overpaid for the room and she is not paying any more.
    After this I ask her to move out. She said OK. It was on August 28th. One month later she didn’t move out she refused to pay rent and bills. On October 1st I gave her a 30-day note to moving out. On October 5th my attorney send her a warming letter to pay and moving out. She was promised to move out. She didn’t. Also in October I found somebody to occupy the room from November 1st. He couldn’t move in and he was , of course, complying a lot. Now he is moving to the living room because he doesn’t have place to stay.

    She is still saying she is moving out but I don’t believe her.
    She doesn’t pay rent for October & November and for bills since August 1st.
    She has lived with us since March 21 2007.
    Please help me what I should do to kick her out and get money back.

    I don’t have with her any written agreement and our apartment is in Brooklyn, NY 11220
    Only I’m on the lease with my landlord.

    PS. She also saying than I just f….ing emigrant and the law is of her site. She is from Texas.

    You have a lawyer working on this? I would expect that your attorney has told you how to evict this person, and how to seek a money judgment for any unpaid rent or utilities.

    The Lawyer just wrote the letter for me but I don’t want to spend more money for him.

    You can evict somebody on your own in NYC, but conventional wisdom is that the city's special rules and regulations make it difficult to do correctly.
