I am planning on filing for divorce next year, I'm just trying to get everything in order first.
We live in the house my husband got in the divorce from his first wife. She signed a quit-claim deed years ago and now only my husbands name is on the title. We have been married for almost 22 years and I have lived in this house the entire time doing my share of the cleaning and upkeep.
In the meanwhile my siblings and I are buying land from my father. This land would have been part of our inheritance but we have decided to go ahead and buy the land and are hoping to build houses and turn a profit. I am buying my share of the land with my own funds and my husband is not involved in the deal in any way. Only my name will appear on the deed.
I have been told that in a divorce I will not be entitled to any of the equity in the house because my husband owned the house before we married, but that he might well be able to take half of my share of the land my siblings and I are buying.
Is that correct? Doesn't seem fair but of course I know divorce laws are not always fair.
