    Default Getting Unverified Debts Off Of a Credit Report

    State: FL

    We recently pulled my wife's 3 bureau credit report because we got it through a free offer. I notice that on the Experian, there is one collection from RJM for $77 and on Equifax there is a collection from America's Recovery N for $175.

    Both of these have been on the report for at least a year. I know that if I ask for validation within 30 days of receiving the first notice of collections they have to respond back in 30 days. However, we have never received any correspondence from either collection agency. To make matters worse, we called RJM to have them look it up, and they could not find my wife's account! I told them if it didn't exist they should stop reporting it. They told me if they can't find it, how could they stop, so I have to dispute it. I disputed it with Experian, and they came back and said they verified the debt.

    I haven't done anything with the Equifax debt. I'm 6 months from graduating and don't want to attract attention to myself while I still have no money.

    I've been reading around and now I can't figure out what my wife's rights are or how we can get this off her report. We are pretty much 100% this is not ours. But we have no proof that it isn't ours since it isn't ours (if that makes any sense).

    Any advice?

    If you can identify what you believe to be an FDCPA violation, consider suing them in small claims court.

    I guess the only violation is that they are reporting a debt that they never contacted us about. However, I don't see how, "I don't know judge, I never got anything" would hold up in any court. Maybe I just need to write the collection agency and see if they respond before I start worrying about whether or not they will respond.
