    Default H1B For a New Business

    Dear all,

    I am a British lawyer who recently passed the NY bar exam; 2 American friends (lawyers too) and I formed a PC (professional corporation) and we are soon to file the H1B application for me; I wonder if the fact that ours is a new company with no sales so far and a share capital of only $100,000 will negatively impact in our petition.

    I asked an immigration lawyer's opinion, he said he had never filed a petition like this but he saw no reason why should the application be rejected. Does any of you have knowledge or experience on a similar case? I did work hard to pass the bar exam and would like to practice in NY for a few years before returning to London.

    Any input will be highly appreciated,

    It seems to me that the problem would lie in getting labor certification, not in getting an H1B approved once the new firm has labor certification.
