    Default Fifteen-Year-Old Charged With Assault

    My 15 yr.old son is being charged with assault (NY). He and some friends were fooling around, it got a little rough and one boy got hurt. Even though my son apologized to both the parents and boy (as did we as his parents), they are pursuing the charges. The police did not question my son or a few of the boys that were there, we were just told to bring him in for an arrest. He will be released to our custody and given a desk appearance. My concerns are that he will have a record that will follow him forever and bar him from certain jobs, and that we will be sued. We have no assets (rent apartment, lease car, no savings). What is our exposure?

    Without knowing the full circumstances, how serious an injury resulted, or what the witnesses have said, it's not really possible to guess how a juvenile court would treat the case.

    The injuries were to his face. They were wrestling, my son had his arms pinned behind him, the boy said "uncle", my son let go and as soon as he did the kid went for his throat. My son pushed him away and he fell over my son's leg hitting the ground face-first. The injuries are abraisons and a cut lip from his braces, but parents are claiming he needs "facial reconstruction and plastic surgery", etc. Witnesses cancel out each other - we have 1 kid that say that's what happened, they have 1 that says that my son threw him to the ground.

    We hired an attorney who is coming with us to surrender him to the precinct. We were told by the cops that he would be processed, released to us with a desk appearance. What are we looking at in terms of long term record and law suit dollars?
