    Default Married on a Visit to the U.S.

    Me and my boyfriend have been going back and forth with each other from New Zealand to America for half a year now. We met online and have been talking to each other 2 years before we met. While this time in the US, we decided to get married because I found out I was pregnant but I have to return to New Zealand in a month or so. How do I go about getting to stay in the US so my husband isn't seperated from the child. This was not planned or staged, and we didn't do this just so that I could become a Citizen. What forms do I need to fill out so that I can stay here and have my child. Please, can somebody help me?

    Is it that you got pregnant during this visit? That you found out about the pregnancy during this visit?

    You can file to adjust status, by filing forms I-130, I-485, I-765, I-131, I-864, you will also need a medical done by a civil surgeon I-693, go to the USCIS website, you can download all of these forms, if you have already overstayed your visa, it may not be wise to apply for advance parole, if you havent overstayed then apply, altho you may not get it in a month or so, if you need to leave the country.

    Well, I found out I was pregnant when we got to the States, which is why we got married. I was using birth conrol at the time too. You think i should contact an Immigration lawyer on this, or am I able to do it myself? Since I was on the Visa Waiver for visiting when I came to the states, I still have another month and so left. Thank you again if you can help me.

    My concern is that you may be deemed to have entered under false pretenses - entering as a tourist when you actually had the intention to marry and seek permanent residency - which could create some real immigration problems. The "safe" approach would be to go home and seek a spouse visa, but that presents other problems. There's no harm in consulting an immigration lawyer - try to find one who will give you a free consultation.

    When you came to the US, did you have intent on staying, if not can you prove this, i.e did you have a job to go back to, can you get a letter from your employers back in your home country, do you still have bank accounts in your hoome country, things like this will show you still had ties with your home country.
