    Default Back Specialist Can't Interpret Functional Capacity Evalution Test Result

    I reside in pa. my question is: if you had major back surgury from a work related hurt the specialist that done the surgury after 8 months from this asked to do a functional capacity evalution test. So when the tests comes in than states he does not know how to read it, than why would he give the test if he can not read the results, I had just lost it asked why would you give this if you cant read it, he said for me???. This just does not sound right to me, the results ended in light duty but not sure if this means forever or what. Would you be able to see if I need a lawyer for this. Thank you kindly for your help

    The back specialist didn't prepare the FCE report, obviously, and you don't even indicate if the back specialist participated in the testing. You also don't indicate what part of the report the back specialist "can't interpret" - I haven't seen it, so I can't guess as to what or why. I also can't guess at whether your disability is deemed temporary or permanent - you didn't share that information.

    It is probably sensible to consult a worker's compensation lawyer - take the report along, as it will help in getting your questions answered. Don't retain the lawyer to represent you until you're sure it will help, as you could end up paying a percentage of all of your future benefits to the lawyer even if he doesn't improve your case.

    Thank you so much for your time, I am on temporary disability and my specialist just wrote a presription for me to get it done to see where I am at. I am so ready for work but not this job, I think it is pretty physical for me, I am 47, female. I thought the reason for him wanting this test is to see how much I could do for work. But, one of my friends said that the lady that is always at the office is the one to recommend it to the doctor and the doctor seen it and does not want anything to do with it. The lady at my side in offices says she works for me, (and I question that, but it does not matter anyways). I just cant believe getting people to read my evaluation for work, so now I am going to try to get my family doctor to do it.

    Oh it is hard to remember what you said than I have to post again, do appologize. My specialist can not read the whole thing from the FCE and the job list that I do. this is suppose to tell me what I can or can not do for my job to get me back to work. I have seen it and read what I can or should not do-this is what he tells me. So i am really upset that he tells me to take this test and than he gets it and says he cant read it!!!!!!!!!!!!!!! My health and life is at stake here and I am a single mom with last one gratuating, I am afraid this will get in the wrong hands and tell me full duty in which my FCE says no that I could possibly get hurt again and my specialist said that I could get parralized if this happens. This is why I am so confuseed. My specialist just says he does not get into telling me if I could go back or not.
    Thank you again and hope I am clearer, this is great to have to help people out in need. I do know there are crooks out there that make it hard for good people and there are good people too.

    A Functional Capacity Evaluation (FCE) is an objective, systematic process of identifying and assessing an individual’s ability to physically function in relation to work and in the performance of activities of daily living (ADL’s). The FCE solution based approach is used to determine “What the individual can do,” and to identify the person’s “ability level” for a successful return to gainful employment or to establish a baseline level of function.

    Workers’ Compensation: After a work related injury, the FCE is used to objectively determine the physical demand level and work capacity of the individual. The objective, functional information is useful to assist the physician, medical team, case manager and employer when developing an appropriate plan of care that eventually leads to closure of the case. At NovaCare, the FCE has been successfully used during rehabilitation treatment to identify the individual’s current level of functioning and promote a safe return to work. Once an accurate ability level is determined, an expedient return to work plan and process may begin. An objective classification of the individual’s abilities can be compared to the jobs physical demand and work levels for return to full time or part time employment. If the individual is unable to return to work in a full time or full duty capacity, then modified work hours and modified work duties can be an appropriate alternative to justify a successful return to work plan. In order to put closure to the case, the FCE is used to establish a final, objective physical demand level when the physician determines maximal medical improvement (MMI).
    At some point, if you are claiming a continuing disability, worker's comp is very likely to want an FCE to document the limits of your capacity. Even if it has no direct relation to the medical care you are receiving, it may help convince worker's compensation that additional benefits are needed, be they continued wage loss benefits, job accommodation, rehabilitation, work hardening, retraining, or something else which helps you shift back into the workforce.

    OMG thank you so very much---I had been on work hardening therapy since late may. As of now I had told my specialist that I am ready for work but not so physical. He told me than if you are than you dont want more therapy they will think your not ready. Far as everything else that is what i thought it was suppose to be to tell me or workmans comp how much i could do, but now so far it is having my family doctor read FCE and my job duties or have workmans comp doctor do it. My specialist is a neurosurgen.
    Again keep up the good work and thank you again.. One question--should i keep this out of the hands of a workmans comp doctor??? if that makes since.

    If you are receiving treatment through your own doctors, and your insurance company wants to send you to its own doctor, you should be aware that the purpose may be to have a doctor give a less than objective assessment of your capacity such that they can deem you fit to return to work.
