    Default Possession of Child Pornography Charges for Computer Images

    I was just recently charged with 9 counts of possesion of child pornography. I had no idea that I was even in possesion of these 9 images. My girlfriend found them while going through a CD-ROM while searching for evidence that I was cheating on her. The police instructed her to bring in my computer, and the CD-ROMs that were in my laptop case.

    I have not been in any trouble with the law in 9 years. If I had known that these images were on my computer, I would have deleted them. I burned the CD and just placed it in my laptop bag.

    What can happen to me? I have a 6 year old daughter at home to worry about.

    I appreciate everyone's help.

    You should consult with an Attoreny right away as you could be facing veru serious and life altering charges. I have to ask as did Bay how do you explain the images got there?

    I don't know how the images got onto the computer in the first place. I know I never downloaded them. The CD was burned from a zip disk I had, which I got rid of. I never once opened the directories after the CD was burned. The hard drive from my old computer, has since been replaced due to a failure.

    I think they were put there by a hacker that I once associated with. I stopped associating with him about 4 years ago. I know that is hard to prove.

    I consulted with a lawyer on Tuesday.
    He wanted $10,000-$15,000.

    I have a court appointed lawyer right now. I don't know how good he is.

    What I would like to also know is, does my having a low bail mean anything? The DA asked for $5,000 and the judge brought it down to $500

    Am I looking at time in jail? I know I should have been more careful. How much time am I looking at?

    Laws are different in each state. What state are you in, and what statute are you charged under?

    Yes a hacker put a select few child porn pics on a hard disk on your old computer, that you backed up to a zip disk before a hard drive failure, and then burnt to a CD. So this information, that a "hacker" put on your computer, was so unimportant you backed it up twice and kept it in your laptop case. While never know what you were backing up (twice) until your girlfriend just so happened to check out the CD.

    You really need to talk to a Lawyer. Your explanation is not very believable even if true

    Massachusetts. I don't know what statute I was charged under.

    I understand that my story is hard to believe, but I am telling you. I never knew that they were even there.

    Does it mean anything if my bail was set to $500 and took them 8 days to execute the straight warrant?

    I was told that since they took 8 days to execute the warrant, and that my bail was set so low, that they don't consider me a danger. Mind you this is just stuff I was being told. It was also mentioned that they are not pursueing the case aggressively either, and that I may not end up with jail time.

    How true can this be?

    No one can say and its likely they are not acting fast as they are investigating the crime. My orignal advice still stands find an Attorney before anything more happens. You need legal advice as you could be facing life altering charges. They have enough to pursue thsi but its likely they are searching for more and may want to question you some more at some point which all the more reason to have an Attorney already working on your side.

    They had the computer since the end of May. They did their search over a period of 2 months and nothing was done still till October. They will not find anything like that on my computer. I don't condone this stuff. I am very against child porn and I don't know how it got there.
