    Default Charged With 1st and 4th Degree Burglary, and Theft Over $500

    this relates to the ebay case...are these charges likely to stick or be dropped simply because I sold items on Ebay? It seems a little ridiculous that they can get a warrant for an arrest on burglary simply because of where the items turned up.

    Like you told in your other thread. Evidence points your way - the beyond a reasonable doubt is established, hence the charges.

    Should we infer from the fact that you have been charged that the serial numbers of the items you sold matched those of the stolen items?

    Have you consulted a criminal defense lawyer yet? These are serious charges, and it's time to do so.

    ONE serial number matched...and there were three items i sold that matched (only in what they were, IE: ipod, camera, no numbers or descriptions, simply that i had posted them online) three out of four that were stolen from this house that I had nothing to do with...but only one serial number. I am talking to two lawyers tomorrow. I have a new question...the newspaper had a title in the paper that says FENCED goods lead to the solving of burglaries in the area...and it doesnt say alleged in the title, nor does it have any police quotes in the story, just says that "police say the sale of a stolen laptop on ebay helped them solve a series of burglaries and thefts, and then states my name and age and all that good stuff. Fenced in this context means "the receiving and sale of KNOWN stolen goods" and it relates to me...so it seems as if the paper is saying I knew they were stolen when I was selling them... which is an unproven statement. There was no evidence or statements of me selling or stealing items in this posting, do I have a case for libel? please say yes it'd be a little light on some pictures

    P.S. Aaron, you are a cool guy for all this advice to people...im really appreciative of this site. Im a business law student, and I like reading all of you guys' posts on different topics, it gives me so much insight on so much! keep it up

    Did it say "John Doe fenced..." or "Police say that John Doe fenced..."? When a publisher's the defendant that's a big issue. But really, if you don't beat the charge, it's the least of your worries. So worry about the criminal charge.

    well...it says "goods fenced on ebay leads to...."
    in the title.

    and I am on top of the criminal charges, meeting with a lawyer. requested a preliminary hoping they get thrown out.
