    Default Timeframe of Civil Action

    Delaware

    If someone is going to be sued for, say, a credit card debt, what is the general timeframe for the events that follow? For example:

    1. How long does it take between the planitiff filing the suit and the defendant being served?

    2. If the defendant answers the "Answer Form", how long before the court hearing?

    3. If the defendant doesn't answer the "Answer Form", how long before a default judgment is issued?

    4. Assuming that a judgment is reached in favor of the plaintiff, is there a general length of time that it takes to begin wage garnishing?

    There are no firm times.

    1. It takes as long as the process server takes to effect service, so it depends on how hard it is to locate and serve the defendant. Sometimes that's the same day the process server receives the documents for service, and sometimes it takes a lot longer.

    2. That depends on the court's calendar, and how busy the court is.

    3. That depends upon when the plaintiff petitions for a default judgment.

    4. That depends upon whether and when the defendant requests garnishment,
    and how long it takes the court to hear and grant their motion.
