    Default Unwanted Guest

    My roommate (not on the lease) has been paying full rent on my behalf directly to the landlord, as I've been out traveling for the last few months. I advised my roommate that I will be moving out at the end of lease term and he had no problem with it, agreeing to move out as well, which he did 2 months early. A week before the end of lease I found out that my roommate had a guest staying with him, which I had no idea about. The problem now is that my roomate is gone and I can't find him, his guest (I don't know if she paid any rent or not to my roomate) does not want to move out, claiming that she lived there and paid rent to my roomate. It's a mess, but I want her out of the appartment as I did not get into any contracts with her, I don't know her and I never met her. If she does not move out by the end of the week, the landlord probably will keep me liable for that (I already explained to my LL about this problem). Could you advise if calling a police will solve this problem or may be changing the locks will help? I tried to ask her nicely, but she is telling me that she can't find a new place to live. The appartment is in NY. Thank you.

    The police will tell you whether or not they will treat her as a trespasser and remove her.

    If they say you have to evict her, then that's what you'll have to do. You can then try to sue her and your ex-roommate for any rent incurred due to her holdover.

    Default Process of Eviction...

    Diving a little more in depth into what KNOWITALL began stating, the leasing agreement has -your- name on it, not your ex-roommate's friend.

    My advice is for you to investigate matters a little bit more; does your lease itself, permit subletting the unit? If not, then you have grounds for evicting your "unwanted guest" <-- however, please be advised, that due to -your- name being documented on the lease from the "get-go", and subletting being a breech of your contract, you risk being evicted yourself.

    Secondly, providing your lease actually does permit subletting, then you should consider requesting to view it (provided it is written). If the leasing terms are oral, then due to your ex-roommate no longer being present, you qualify as the landlord, thus rendering you the right to evict.

    Lastly, as a tenant, you legally have the right to above all, contact the police for any further assistance.
