    Angry Is My Lawyer Liable for Increased Mortgage Costs, in Pennsylvania

    I filed a Chapter 7 bankruptcy a year ago and had to convert to a 13. When the filing went through, my lawyer failed to file a new motion for stay involving our home. His incompitence almost had our house taken through foreclosure. Even though we didn't lose the house, we now have to pay an ADDITIONAL $10,000 for legal proceedings and fees accrued by the mortgage company to persue the foreclosure.

    Is my lawyer liable and is there a way that I can get this cost removed?
    Please advise.

    If you owe the amount to the bank, you owe it. In my experience, they're not going to give up money because they feel bad about your lawyer's having made a mistake.

    You can consult a legal malpractice lawyer about the possibility of making a claim against your lawyer.
