    Default NSF Check

    I'm having a serious problem with my ex-landlord. I unintentional wrote a check to her for 600 that didn't clear in August. I must say, this was not the first time this happened, but I always paid her back and had be a tenant of her for 3 years. I paid her 300 a few weeks later after she informed me the check didn't clear. A few weeks later I paid her 900 to cover both August and September. During this time, she filed charges against me for nsf check with the courts, even though I was keeping in contact with her about when I could pay her in full. I also informed her that at end of Aug. I would be moving out by the end of Sept,beginning of Oct. Yet she continued to harass me with threats of warrants and eviction.
    She then filed paperwork with the courts for eviction. We went to court, and the judge said if I paid her the three hundred she was asking for her supposed late charges and fees, that I could stay until the end of Oct., and my security deposit could be used as last months rent. I proceeded paid her 300. After I paid her the money I owed her, I asked her several times to drop the charges regarding the inf check, but she never responded.
    She then said if I paid her 300 towards Oct, that she would drop charges. I agreed, and met her at the apt to pay her. She wrote out a receipt and signed it and put at the bottom that charges could be dropped towards me.
    I went to court and theJudge postponed the date because the DA hadn't heard back from my landlord. The DA gave me his phone number for my landlord to call. I left the number on her VM and asked her to call. On Nov 2nd, I went back to court. The DA said he hadn't heard from her and called her right then at the court. She told him I still owed him money and that she didn't want to drop charges. When in reality, she would have owed me 300 for my security deposit at that point.
    On top everything else, On Oct 29 I was on my way to the apt to finish moving out when she called and left a Vm saying she was at the apt and was upset that I was not out, because she wanted to show it to people. I called her back and then all of a sudden she was with the police at the apt. because supposively someone broke the lock and the door was wide open. She then left another message on my VM saying she changed the lock and I would have to contact her to get my stuff. I luckily got to the apt. before she left, but she said she would lock it up as sone as she noticed I wasn't there. I went in and nothing was stolen, which seemed suspicious. The whole thing was yet another way of her trying to intimidate and threaten me.

    I have to go to court next week with a lawyer that I can not afford. Does anyone know if I would have a case against her for harassment and/or some form of extortion?

    No, to both.

    I have a question - why didn't you know that the check bounced until after the LL told you?
    I paid her 300 a few weeks later after she informed me the check didn't clear.
    Your bank should have informed you that the check didn't bounce within days by mail, within minutes by internet, and YOU knew when you wrote it, that it wouldn't clear.

    NO I didnt. I get paid by commission. My check varies. The only thing I am guilty of is not paying more attention to my checking account.

    I used to get paid once a month by commission. I didn't write a check until the money was in the bank. And, if I bounced a check, I knew right away, by the methods above.

    I think we can accept it as a given that some people are much more careful about balancing their checkbooks than others.
